General Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN
RULES APPLICABLE TO ALL SWEEPSTAKES: These General Official Rules (“General Rules”) govern all sweepstakes promotions (“Promotions”) conducted by Sugarlands Distilling Company, LLC (“Sugarlands” or “Sponsor”) on its website and/or social media channel pages (e.g., Facebook, Instagram, Twitter).

ADDITIONAL RULES: Each Promotion may also have additional terms that govern that specific Promotion (“Additional Rules”). The Additional Rules, if any, will be contained within or linked to the Promotion’s marketing materials. If there are Additional Rules, the Promotion will be governed by both the General Rules and the Additional Rules. The Additional Rules will prevail in the event of an inconsistency between the General Rules and the Additional Rules.

ENTRY PERIOD: Each Promotion will begin and end on the dates, times and time zones (the “Promotion Period”) detailed in the Promotion’s marketing materials or Additional Rules. PRIZES: The prize for this Promotion consists of one (1) Field & Stream® Premium Subscription valid for one (1) year, one (1) Field & Stream® Gift Card with a retail value of One Hundred Dollars ($100 USD), and one (2) two-night stay at the Field & Stream Lodge located in Bozeman, Montana (the “Prize”). In addition, round-trip economy airfare for the winner to and from the nearest major airport to Bozeman, Montana will be provided by Sponsor. Airfare arrangements will be made at Sponsor’s sole discretion and may include reasonable travel restrictions, blackout dates, and routing limitations. Any upgrades, additional baggage fees, seat selection fees, meals, or incidental expenses are the sole responsibility of the winner unless otherwise expressly stated. The two-night lodge stay is subject to availability, blackout dates, and the Field & Stream Lodge’s standard terms and conditions. The Prize does not include additional nights, room upgrades, meals, resort fees, incidentals, ground transportation, gratuities, or any other expenses not expressly stated herein. All Prize details, including but not limited to travel arrangements, lodging accommodations, subscription access, and gift card usage, are subject to availability and Sponsor’s sole discretion. Gift card prizes are subject to all terms and conditions generally applicable thereto. Sponsor will not replace lost or stolen gift cards. The Prize is awarded “as is” with no additional warranties, express or implied, beyond those provided by the applicable service providers, if any. Winners are solely responsible for all federal, state, and local taxes associated with acceptance or use of the Prize. Winners are also solely responsible for any costs, fees, or expenses not expressly included in the Prize description.

The Prize may not be transferred, assigned, or substituted prior to acceptance. No cash or other substitution is permitted, except that Sponsor reserves the right, in its sole discretion, to substitute the Prize or any component thereof with a prize of equal or greater value for any reason.

Physical Prize components, if applicable, will be delivered to the mailing address provided by the winner within six (6) to eight (8) weeks following winner confirmation. Sponsor is not responsible for lost, late, damaged, or misdelivered prizes or communications. Returned or undeliverable prizes will not be reissued.

HOW TO ENTER
To enter the Promotion, participants must scan the QR code displayed on the official Promotion table tents located at the bar using a smartphone or other internet-enabled mobile device. Upon scanning the QR code, entrants will be directed to the official Promotion entry page and must complete and submit the entry form in accordance with the on-screen instructions.
Limit one (1) entry per person per Promotion, unless otherwise stated in the Promotion’s marketing materials or Additional Rules.
Internet access is required to enter. Standard data and messaging rates may apply if entering via a mobile device, and participants are solely responsible for any charges incurred from their mobile service provider.

All entries must be received during the Promotion Period to be eligible. Entries that are incomplete, inaccurate, or not submitted in accordance with these Official Rules or the instructions provided on the entry page will be void.

ELIGIBILITY
No purchase is necessary to enter any Promotion or to win any prize. Each Promotion is open only to natural persons who: (1) are legal residents of a state within the U.S. or the District of Columbia; (2) are age 21 or older as of the entry date; and (3) have agreed to these General Rules and the Additional Rules, if there are Additional Rules. The Additional Rules or Promotion advertising materials may include additional eligibility restrictions.

Promotions on social media channels will typically require that entrants be registered users of the applicable platform which follows Sponsor or one of its brands (including but not limited to SUGARLANDS SHINE, ROAMING MAN whiskey, HIGH ROCK vodka, and APPALACHIAN SIPPIN CREAM cocktails) for eligibility. Profiles may need to be set to public to allow Sponsor to capture the entry activity and communicate with potential winners.

Persons who are immediate family members (parents, children, siblings, spouse) of, or live in the same household as, employees, officers or directors, or are themselves employees, officers or directors, of Sponsor or any of its parents, subsidiaries, affiliated companies, advertising or promotion agencies are not eligible to participate in any Promotion.
Sponsor reserves the right to verify eligibility qualifications of each prospective winner. Void in Puerto Rico and where prohibited.

Use of any automated system or method (e.g., a computer program, robot, etc.) will void each entry made by such system or method. A person may enter each Promotion only as many times as is detailed in the Promotion marketing materials or the Additional Rules. If a person attempts to submit more entries than are permitted or if a person does not satisfy the other entry conditions, then all of that person’s entries may be void in Sponsor’s sole discretion. Entries that are in violation of these General Rules, the Additional Rules (if applicable), or the other conditions detailed in the Promotion’s marketing materials may be void in Sponsor’s sole discretion. If Sponsor suspects or determines an actual or attempted fraud, tampering, impairment, or disruption of the administration, security, or fairness of the Promotion, or if Sponsor suspects or determines an actual or attempted violation of these General Rules, the Additional Rules, or the Promotion marketing materials, then Sponsor may, in its sole discretion, void any and all entries of the individual that it believes is responsible for or is otherwise involved with such acts.

ANY ATTEMPT BY ANY INDIVIDUAL TO DAMAGE OR HARM ANY WEBSITE, SOCIAL MEDIA PAGES OR ANY PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL(S) TO THE FULLEST EXTENT OF THE LAW.

ODDS OF WINNING: The odds of winning a prize in a Promotion depend on the number of eligible entries received during each Promotion Period.

CONSENT & LICENSE TO PUBLICITY AND USE: Except where prohibited by law, each person, by submitting an entry to a Promotion, consents and grants to Sponsor (and its agents and assigns) the worldwide, perpetual, royalty-free, fully paid, irrevocable, sublicensable, and unrestricted right and license to use and exploit all materials and information submitted in connection with the entry to the Promotion (e.g., entrant’s name, voice, likeness, biographical information, email address, comments, photographs, videos) in any manner or media whatsoever (e.g., websites, social media channel posts) for any promotional or publicity purposes without limitation. If the entry materials incorporate other individuals (e.g., an image or video of another person) or incorporate another individual’s intellectual property, then the entrant must secure all necessary releases, clearances, and permissions to allow Sponsor to use and exploit those materials consistent with the above license grant. By submitting an entry with comments, photos, video or other content, participants confirm that the content is original to the participant and that it does not violate the intellectual property or any other proprietary rights of any person or entity.

SELECTION AND NOTIFICATION OF WINNERS
WINNER(S) WILL NOT BE REQUIRED TO BE PRESENT AT THE TIME OF THE DRAWING.
Winners will be selected at random from among all eligible entries within 5 days after the Promotion’s end date, unless otherwise stated in the Additional Rules.
Each potential winner will be notified by email or by direct message through the applicable social media channel or by cell phone within about 48 hours after the selection. Potential winners may also be posted to the applicable social media page. Participants are solely responsible for checking the promotion posts and/or direct messages and/or e-mails and text messages to see if they are potential winners. Each potential winner must formally claim the prize within 7 days after the notification attempt, following the instructions provided in the notification, including appropriate age verification.

If a prize notification is returned as undeliverable, or if a potential winner fails to sign and return any required documentation within the designated time period, or if a potential winner is found to be ineligible or not in compliance with these Official Rules, then that potential winner will be disqualified and the prize forfeited. No alternate winner will be selected, unless otherwise stated in the Additional Rules. Sponsor’s decisions and actions with respect to the Promotions, including but not limited to the confirmation of winners, are final and binding.

WINNERS LISTS: To request the name(s) of the winner(s), mail your request (and a self-addressed stamped envelope) to: Sugarlands Distilling Company, LLC, 805 Parkway, Gatlinburg, TN 37738. Please identify Promotion for which the winner list is being requested. Requests for winner lists must be received by Sponsor at the address above no later than 30 days after the end of the applicable Promotion Period. Allow six to eight weeks for processing of requests.

SPONSOR: Sugarlands Distilling Company, LLC, 805 Parkway, Gatlinburg, TN 37738, is the sponsor of each Promotion.

SOCIAL MEDIA PLATFORMS: Any Promotion advertised or operated on any of Sponsor’s social media channel pages or profiles is in no way sponsored, endorsed, administered or associated with Facebook, Instagram, Pinterest, Twitter, or any other platform. Any such Promotion is subject to all terms of conditions for promotions operated on such platform.

GENERAL PROVISIONS
In the event of a dispute as to the identity of an entrant, entries will be deemed made by the authorized account holder of the email address associated with the entry or the individual associated with the social media profile from which the entry was submitted, as applicable. The "authorized account holder" is deemed as the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry and or the social media handle associated with the winning entry.

If for any reason a Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, human error, issues with ta social media platform, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right in its sole discretion, to disqualify any individual who may have tampered with the entry process, and to cancel, terminate, modify or suspend the Promotion, and to select winners from among the eligible entries received during the Promotion prior to such event. Sponsor reserves the right to void suspect entries, in its sole discretion. The use of multiple social media profiles or e-mail addresses by a single individual to generate additional entries is prohibited and will result in the disqualification of any such individual found to be using such methods from participation in the Promotion, as determined in the sole discretion of Sponsor. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or
destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, mobile device, software, failure of any entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from participation or downloading any materials in the Promotion. Sponsor is not responsible for late, lost, illegible, incomplete, stolen or misdirected mail, e-mail or other communications.
Sponsor’s failure to enforce any term of these General Rules or the Additional Rules do not constitute a waiver of Sponsors ability to enforce its rights under these General Rules or the Additional Rules.
The invalidity or unenforceability of any part of these General Rules or the Additional Rules shall not affect the validity or enforceability of any other part of these General Rules or the Additional Rules. In the event that any provision of these General Rules or the Additional Rules is determined to be invalid or otherwise unenforceable, these General Rules or the Additional Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained within these General Rules or the Additional Rules.

The names, likenesses, logos, and images of individuals, groups, companies, products, and services mentioned in these General Rules, the Additional Rules, or in any promotional materials are used for identification purposes only, may be the copyrighted properties and trademarks of their respective owners, and do not imply any association with or endorsement of Sponsor, except as otherwise indicated.

DISPUTES & LIMITATIONS OF LIABILITY: By entering into the Promotion, you agree to resolve any and all disputes, claims, and causes of action arising out of or connected with each Promotion (an “Action”): (1) individually (i.e., you expressly waive your right to participate in any type of class action lawsuit relating to the Promotion by entering into the Promotion); and (2) exclusively by the Federal or State courts located in Gatlinburg, Tennessee.
By entering into the Promotion, you agree that: (1) if you are successful in an Action, then your recovery is limited to (i.e., will not exceed) the total prize value divided by the total number of eligible entries; (2) You waive all indirect, incidental, punitive, special, disgorgement, consequential damages of any kind (including, without limitation, lost profits), costs (e.g., attorneys’ fees, expert fees, filing fees, fines), or expenses, even if you have notified Sponsor of the possibility of such damages.
This General Rules and the Additional Rules (if any) are governed by and must be construed in accordance with Tennessee state laws, without regard to its conflict of laws doctrine. If a court finds any provision of these General Rules or the Additional Rules invalid or unenforceable, then it is the parties’ intention that the court enforce: (1) such provision to the maximum extent permissible; and (2) the other remaining provisions of these General Rules and the Additional Rules (if any).

INDEMNIFICATION & RELEASE
By entering into the Promotion, you agree to release, defend, indemnify, and hold harmless Sponsor, its parent, subsidiary and affiliated companies, its advertising agencies, any applicable social media platforms, and all of their respective employees, officers, directors, agents, and representatives for any injury, claim, loss or damages of any kind to persons, including death, and property, due in whole or in part, directly or indirectly, from participation in a Promotion, the acceptance, possession, use or misuse of any prize, or participation in any prize-related activity, or Sponsor’s use or exploitation of the materials and information submitted in connection with your entry in the Promotion (e.g., an allegation that Sponsor’s use of your entry materials violated a third party’s Intellectual Property right, confidentiality right, privacy right, or contract right, or lacked the third party’s authorization).

PRIVACY NOTICE: By entering, you agree that Sponsor and its affiliates may send you marketing messages and otherwise use the personal information collected from entrants subject to Sponsor’s Privacy Policy. Entrants should read the “Privacy Policy” located at https://www.sugarlands.com/privacy/. You may unsubscribe from any communications at any time by following the instructions at the bottom of any communication.
